What are the duties of a low hazard workplace?

The low hazard class does not remove duties, it stretches the intervals. The risk assessment and the emergency plan are renewed every six years; basic training is at least eight lesson hours and repeats every three years; the specialist works 10 and the physician 5 minutes per employee a month.

What low hazard means

Of the 2,142 six-digit activity codes in the annex to the Communiqué on Workplace Hazard Classes, 898 sit in the low hazard class. That is 41.9 percent of the list. The class follows the activity code of the main work carried out at the site.

Low hazard sites with fewer than 50 employees

Article 6 of Law No. 6331 allows employers or employer representatives of low hazard workplaces with fewer than 50 employees, who do not hold the required qualification and certificate, to carry out occupational health and safety services themselves provided they complete the training announced by the Ministry. Two items stay outside that permission: pre-employment and periodic medical examinations and tests. Health surveillance remains a physician's work.

Duties that do not depend on the hazard class

  • Periodic inspection of work equipment. Intervals and criteria are read from Annex III of the Regulation on Health and Safety Conditions in the Use of Work Equipment and do not change with the hazard class.
  • Accident and occupational disease notification. Work accidents are notified to the social security institution within three working days.
  • Health surveillance. Failing to provide health surveillance carries a 2026 fine of TRY 22,194 per employee.

The fines do not shrink to nothing

Penalty tables are read at the intersection of workplace size and hazard class; the low hazard class gives the lowest cell, not a zero. Failing to carry out a risk assessment starts at TRY 66,725 and failing to assign an occupational safety specialist at TRY 111,263, the latter repeating every month while the breach continues.
