What happens if the hazard class changes?

If the hazard class changes, the employer must carry out the work the new class requires within 90 days and notify the Directorate General of Occupational Health and Safety. The change reaches everything: specialist and physician time, the risk assessment interval, training hours and the size of the emergency teams.

The window: 90 days

Article 3 of the Communiqué on Workplace Hazard Classes is explicit: where a Ministry decision results in a change to the hazard class of a workplace, employers must carry out the work and procedures the hazard class requires within 90 days and notify the Directorate General of Occupational Health and Safety. The decision is also served on the workplace.

How a class changes

  • Change of activity. The employer reports a change in the main activity to the Ministry of Labour and Social Security within one month (Art. 2/2).
  • Appeal. Appeals against a hazard class are assessed by the Ministry, concluded on the registration records and the main work they rest on; the site is not inspected for its main work unless considered necessary (Art. 3/1-2).
  • Inspection. If a Ministry inspection finds the main work differs from the registration records, the class may be redetermined on the inspection records (Art. 3/3).
  • Amendment of the annex. Where a commission formed by the Directorate General decides that the class of an activity code changes, the communiqué itself is amended (Art. 3/5).

Moving up and moving down are not the same job

When the class rises, every item left undone is a separate administrative fine. In the 2026 tables, failing to carry out or commission a risk assessment starts at TRY 66,725, and failing to assign an occupational safety specialist starts at TRY 111,263 and repeats every month while the breach continues. When the class falls the required times shorten, but existing contracts, training records and plans do not lapse by themselves; they are reviewed against the new class.
