Specialist and physician share the same cell
Article 6 of Act 6331 governs occupational health and safety services; penalty article 26/1-b covers breaches of that duty. "Not appointing an occupational safety specialist" and "not appointing a workplace physician" are two separate items in the penalty table, but their 2026 amounts are identical. If both are missing, two separate fines are issued.

Other health personnel is a separate item
In very hazardous workplaces with ten or more employees, failing to appoint other health personnel is a third item. The base amount in 2026 is TRY 55,597; it becomes TRY 111,194 in a very hazardous workplace with 10-49 employees and TRY 166,791 in one with 50 or more.
Appointing is not enough
Other sub-paragraphs of the same article penalise the duties that start after the appointment. The lower end of each range below belongs to a low-hazard workplace with fewer than 10 employees, the upper end to a very hazardous workplace with 50 or more.
- Failing to provide the appointed person or the service provider with equipment, tools and space (6/1-b): TRY 33,326 - 99,978.
- Failing to ensure coordination between those delivering the services (6/1-c): TRY 33,326 - 99,978.
- Failing to implement measures that were reported in writing and comply with legislation (6/1-ç): TRY 22,194 - 66,582.
- Failing to inform appointed persons, service providers and workers arriving from other workplaces about the risks (6/1-d): TRY 33,326 - 99,978.
- Restricting the rights and powers of the specialist or the physician (8/1, penalty article 26/1-c): TRY 33,326 - 99,978.
- Failing to set up the workplace health and safety unit (8/6, penalty article 26/1-c): TRY 33,326 - 99,978.
These items are independent: having made the appointment does not reduce the fine issued because the appointee was given no space or equipment. Failing to set up the occupational health and safety board in workplaces with fifty or more employees and continuous work lasting more than six months is another separate item, TRY 44,443 to TRY 133,329 in 2026.
